  • Fill out a divorce application as either a sole applicant or jointly with your spouse (using Form DB).
  • Submit the completed application to a divorce centre either through an online platform or by post, along with the appropriate court fee, which is presently £593.00
  • Apply for a conditional order once your spouse acknowledges the application, and after a 20-week waiting period.
  • Apply for a final order after a further 6 weeks, once you have obtained the conditional order.

We can advise you on the relevant provisions of the Matrimonial Causes Act 1973, including the options for obtaining a divorce. A no-fault divorce is based on the irretrievable breakdown of the marriage. This is established by showing that the marriage has broken down irretrievably, as evidenced by one of the following facts:  

  • Adultery
  • Desertion
  • Unreasonable behavior
  • Separation for a period of two years with the consent of both parties
  • Separation for a period of five years, regardless of the consent of either party
 
The most commonly used fact is unreasonable behavior, as it requires the least amount of proof and is less likely to involve lengthy legal proceedings.
